Trademark

W&M has an active trademark practice involving trademark searches, application completion and filing, due diligence, prosecution, and litigation.  W&M has experience with obtaining registrations for trademarks and trade dress, negotiating and drafting trademark agreements for purposes of  licensing and assignment, and monitoring or renewing trademark registrations.

Copyright

Registration of a copyright is necessary to prevent infringement.  W&M can obtain copyright registrations on behalf of Clients, and protect copyrights in valuable works of authorship, such as for computer software, art, literature, music, video and film, photography, and products.

W&M also consults on issues involving ownership rights, "works for hire", derivative works, and assignment agreements.

W&M has experience in prosecuting and defending against copyright lawsuits, as W&M evaluates the specific exclusive rights involved and determine if the use is subject to the "fair use" doctrine.  W&M then assists the Client to establish a strategy to successfully defend against infringement or pursue infringement litigation against improper users.
