March 2011

In a highly contentious litigation between competing foster care placement programs, W&M are successful on Motion for Summary Judgment on claim of defamation, and obtain dismissals with prejudice on remaining causes of action for Intentional Interference with Prospective Economic Advantage and Unfair Business Practices (B&P 17200).

W&M obtain settlement for client following a successful adversarial bankruptcy proceeding on a business fraud claim, which defendant attempted to discharge via bankruptcy.

July/ August 2010

W&M successfully settle restaurant partnership dispute between the two owners, with W&M client receiving the business, its assets, its profits and all of its future revenue streams.

W&M obtain a dismissal with prejudice for husband and wife accused by their neighbors of creating a nuisance, of trespassing, and of negligence in the maintenance of a large parcel of uninhabited land.

W&M obtains a dismissal in a medical malpractice action for a pediatric gastroenterologist who is accused of perforating a patient’s colon during a colonoscopy. The initial demand to settle the case was $1,000,000.00, but the case is ultimately dismissed prior to trial without any payment based upon the strength of the medical experts retained by W&M.

June 2010

On the eve of trial, W&M obtain a dismissal and do not pay any form of monetary settlement on behalf of a wealthy client accused by ex-wife of transmitting an undisclosed sexually transmitted disease to her, thus allegedly resulting in her permanent disability and inability to work. The case was extremely contentious and was dismissed after aggressive discovery demonstrated that plaintiff was unfaithful during the marriage, and was also earning unreported income by working online for out-of-country clientele.

W&M negotiates a lease modification for a retail tenant in a shopping center.

W&M represents a commercial tenant who is sued for breach of lease and back rents. After moving the Court to bring the tenant out of default, W&M obtains a very favorable settlement to resolve all the claims.

April/ May 2010

W&M obtain dismissal with prejudice on the eve of trial in wrongful death and elder abuse case on behalf of nursing home physician accused of permitting a deadly dental tooth extraction to occur on a resident. W&M client is the only party in the litigation that does not settle out of the case.

W&M prepares revisions to the governing documents of a large homeowners association.

W&M after 2.5 hours following a 12 day jury trial, Jeffrey A. Walker obtains an 11-1 Defense verdict on behalf of a pain management physician and his group in a malpractice action, wherein the 50+ year old female plaintiff alleged that the physician's cervical injections caused a spinal abscess and vertebral osteomyelitis, thus leaving her completely disabled.

W&M guided a home Owners Association through the process of a Board of Directors recall election.

W&M successfully opposed a motion to appoint a receiver in a partnership dispute.

W&M obtains favorable resolution of dispute amongst physician litigants in claim over damages stemming from an injury on medical premises.

W&M successfully assists a California physician with medical board accreditation issues in Oklahoma.

June 2008

Jeff Walker successfully defends family of 7 in Labor Commission Hearing with the Division of Labor Standards Enforcement (DLSE) on accusation by an alleged former domestic employee seeking over $83,000.00 in unpaid wages, overtime, "wait time", fees and penalties.

On the first day of trial, Jeff Walker successfully settles wrongful death case of California Highway Patrol officer and father of four in a premises liability claim for defense costs, which were approximately 1/10th of the original settlement demand.

May 2008

Doug Mann lectures on Intellectual Property Rights and Copyright Issues at the Art Institute of California.

Doug Mann obtains dismissal with prejudice on horrific gastroenterology case involving patient who lost most of GI tract due to alleged malpractice. Settlement demand as to all parties exceeded $6,000,000.00; W&M's client did not have to pay a penny.

Rebekah R. Main successfully opposes Motion for New Trial in Orange County elder abuse case originally resulting in a defense verdict. In same case, Rebekah also obtains large cost award pursuant to C.C.P. §998, including thousands of dollars in expert witness fees.

Jeff Walker secures dismissal with prejudice of chiropractor on the eve of trial with allegations consisting of negligent manipulation resulting in cervical spinal damage.

W&M settle a dispute on behalf of a retired physician with the California and New York Medical Boards, both of which were seeking to revoke the physician's license and deem him incompetent to practice medicine.

February 2008

Jeff Walker obtains a 10-2 defense verdict in an 11 day wrongful death ERCP gastroenterology trial brought by decedent's husband and adult children in the Rancho Cucamonga Superior Court.

W&M is recognized by San Antonio Community Hospital as a hospital supporter in the community, and is named an award recipient and new member into the Frances Mary Paul Circle.

Rebekah R. Main is victorious on trial de novo appeal of an adverse Labor Board decision against client facing thousands of dollars by former employee over alleged back wages, penalties, and fees.

January 2008

Jeff Walker secures a 12-0 defense verdict in Riverside Superior Court trial for cardiologist accused of failing to diagnose acute, fatal cardiac event and not providing more aggressive therapy to a 54 year-old father and parent.
